i'm in the process of making a spare car key (open car plus ignition as oppose to the full thing) for my MK6 but i'm running into problems because the "chip" doesnt seem to be the right one to match the vehicle (this in Dunedin mind you). is it supposed to be a patented thing or are there generics available?

it's not patented per say. it's an ID48 chip, 315, 415 or 433Mhz frequency. Cannot be coded with normal key coders, also these chips cannot be recoded to different vehicles either.

They run on an immobilizer system called GECKO,

So you need to insure the ID48 chip is the correct frequency first and fore most.
